PLEASE READ EVERYTHING CAREFULLY
BEFORE COMMISSIONING ME

By commissioning me in any kind of way, you are agreeing to the terms of services below.
Any statement can be bound to change if discussed with me, the artist, prior to the commission.

GENERAL Terms

✦ Please write in a clear and polite manner when messaging, as well as provide clear reference when requested.✦ I, the artist, reserve the right to deny or cancel the commission if I don't feel comfortable drawing it or the client is proven to be troublesome.
Any ill behavior will not be tolerated and the commission will be canceled if it occurs!✦ Commission prices are subject to change, but price change will not apply if a client is in the queue for a commission and they made their commission request before the change took place.✦ Clients only purchasing my services and the high resolution JPG and/or PNG of the finished artwork via email or a wetransfer link in said email.
You will not receive any physical prints, nor are you allowed to make any profits from them.✦ I hold full rights to the artwork, which means I may post it to other sites, such as Twitter, Instagram, and Pixiv, present it in future art books/portfolios and my own marketing.✦ If the client request their commission to remain private, additional fees will be charged!✦ Clients must state whether their commission will be used solely for personal use or if they intend to use it commercially and potentially for profit off of the work.
Commercial work will ALWAYS inquire an additional fee.✦ Re-posting the watermarked version of the image is allowed, as long as proper credits is given to me, "Chie00chan". Clients are NOT allowed to claim it as their own art!✦ Clients are allowed to use their commissioned art as decoration for social media sites, for example as an profile icon, as long as it's a personal account and they are NOT making any profit from it!✦ Clients are free to print out the commission or even make merchandising of it, as long as it's for PERSONAL use only and NOT for sale!✦ All works made by me (Chie00chan) are NOT authorized for use in any blockchain-related technology including NFTs and any form of cryptocurrency.

ORDERING & Payment

✦ All orders are collected via my Commission Form.
Please fill out the form and send it to me per email or DM (likely Twitter), agencies and companies, please contact me via e-mail!✦ Commissions must be paid in full upfront, or 50% upfront and 50% once the sketch/base color is confirmed to be satisfactory by the client.✦ Invoices get send through paypal, the only currency accepted is EURO.✦ Orders are not first come first served. Each commission is selected based on how well I think I can fulfill the request and whether I personally like the project or not.✦ Clients are free to wait until it's their turn in the queue since I take multiple commissions at a time.✦ If there is no respond within 48 hours of me contacting the client about the commission, the spot will be given to someone else.✦ If the requested character is extremely detailed, additional fees will be added. This will be discussed before sending the invoice. The client is allowed to switch the character out if they want to not pay extra.✦ Again please be sure of commissioning me, do not waste my time by canceling the order if there never was an intention on paying for it. If this occurs repeatedly said client gets blacklisted!✦ Refunds are allowed to be requested if the commission has not been started, there are No refunds otherwise!

Progress

✦ The client must provide a clear idea of the work they would like, the artist will then provide the client with the rate.✦ The client must provide clear reference images if required!✦ The request will be started once either full payment or 50% of the payment has been received.
I, the artist, will confirm with the client that I have received payment.✦ Work in Progress will be given to the client in form as a low resolution JPG after the sketch.✦ If the client has decided to pay 50% upfront, the other 50% must be paid once they have confirmed with the artist that the sketch is ready for lineart and color. The artist will move on with the work once again after confirming with the client that full payment has been received.✦ Time consuming changes will inquire an additional fee and are ONLY possible in the sketch phase! The first max. 3 small changes (examples: changing a character's hair color, adding an accessory, etc.) is free.
Additional changes will require an additional payment of 10% of the full price (example: a small change to a 100€ commission will cost 10€).
Large changes (example: pose redraws, a change in costume, etc.) will cost an additional payment of 15% of the full price.
Change fees must be made upfront when a change is requested. Changes will not be made until the artist has confirmed that payment has been received!✦ If the client is commissioning multiple pieces (example: a fanart series, a poster series, a merchandise series etc.), the client can either choose to pay the amount for the entire project upfront/50-50, or choose to pay upfront/50-50 on a piece-by-piece basis.✦ The work request will be started as soon as possible once payment has been received. The artist will inform the client if there is a queue for commissioned work and will keep them informed of their place in line.✦ The client will be sent a high resolution JPG and/or PNG of their commission via email or a wetransfer link in said email once the work is done.

Customer Satisfaction

✦ I, the artist, will do everything I can to make my client happy.✦ However, changes can not be made after the work is complete and the client has received their high resolution file via mail.✦ I, the artist, ask that the client be clear with what they would like from the beginning to avoid any major issues and minimize the change of needing changes made.

Copyright/Usage Policy

✦ I, the artist, hold every right to the produced artwork, not the client.✦ Therefore I am allowed to use the artwork to: promote myself, display it anywhere to my liking, post it wherever I want.✦ If the client request their commission to remain private, additional fees will be charged!✦ The client is allowed to use the copyrighted artwork for personal use ONLY, unless agreed otherwise.
Print the art for personal use, and claim the right of their character(s), but not the drawing itself.
Share the artwork on their own private social media pages and/or use the artwork to promote themselves (example: as their profile icon) as long as they are not making profit off it and with proper credit to the artist.If you break the copyright infringement in any way, every right you had to the drawing will be retracted!✦ The following is considered copyright infringement:
- Reproducing/using the artwork commercially (without purchasing said rights).
- Taking credit for the artwork.
- Removing any watermarks/signatures.
- Altering the artwork without my, the artist's, consent.✦ Commercial Usage:
A Purchase of Commercial rights to the artwork will be between x1,5 and x2 of the original price, depending which Type of Commercial Right you purchase.
Credit to me, the original artist, is still required for usage of the artwork, even if altered or edited!✦ Private commissions will always inquire a 50% fee.

Canceling/Refunding Policy

✦ I, the artist, have the right to cancel and refund the money of your commission at any time.✦ The client may only request a cancellation and refund if the commission has not been started. Otherwise NO REFUNDS will be given.✦ If payment has not yet been made, the client has the right to cancel the commission.✦ If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
You also will be forbidden to commission me, Chie a.k.a Chie00chan, ever again.
